What Can Be Used as Bail Bond Collateral?

Bail bonds are very common. Bail bonds are generally used to bail out loved ones who have been
arrested and are in jail. Bail bonds are set and posted by the court. Judges often set bail high, especially if someone is charged with a major or violent crime. In many cases, the arrested cannot afford to pay the full amount of the set bail.  Often surety bonds or secured bonds are the first option, wherein the arrested will just pay 10% of the full amount of bail.

Aside from surety and bail bonds, there are many other types of bail bond collateral. Here is a list of the common types of bail bond collateral:
  1. Property Bond - A land lien is given to the court in exchange of the jail release. In the event that the dependant does not appear in court for scheduled hearings, the property shall be foreclosed.
  2. Home - Homes can also be used as collateral. For a home to be used as collateral, 150 percent of the equity in the home is required. This type of collateral could take up to several weeks to process as it involves buying and selling.
  3. Land - This is the most common type of bail bond collateral that can be used in addition to cash.
  4. Bank Account Balance - The balance in a bank account can be also used to secure the bail bond.
  5. Car - Cars can also be used as a bond. Like land or home, if you fail to appear in court for scheduled hearings, you will lose your car.

What are Bail Bonds and Surety Bonds?

By definition, a bail bond is a written promise made to a court.  This written promise states the amount of the bond the arrestee shall pay in exchange for the arrestee’s release from jail.  This written promise states that the arrestee will arrive in court on the scheduled hearing date. When an arrestee or arrestee’s family is unable to pay for the full amount of bond, a surety bond becomes an option.

Surety bonds are a type of bond, wherein another person, often a bail bondsman, takes responsibility to ensure the arrestee will arrive in court for the scheduled hearing.  With a surety bond, you can only pay 10 to 20% of the full amount of bond.
